LEGAL NOTICE

This website is operated by Pebble & Polish, Inc. (“Pebble & Polish,” “we,” “us,” “our”). By using this website, you agree to the terms, conditions, and policies outlined here. These policies supersede those presented by third parties (e.g., Facebook, Instagram, Etsy, PayPal).

We appreciate your visit! Pebble & Polish is an extension of our love for rare and beautiful antique jewelry. We want you to adore your Pebble & Polish pieces, and we strive to make your experience easy and pleasant. If you have questions or concerns, please reach out—we’re here to help!

 

RETURNS POLICY

We offer a five-day examination window for eligible purchases. You may return your first refund-eligible item in its original, unaltered condition within five days of receipt for a full refund, minus all costs incurred by Pebble & Polish (e.g., all shipping, insurance, international fees). 


How to Return an Item

Email us within five days of receipt to begin the return process.

Wait for our confirmation & return instructions—do not return an item without them.

Ship the item back within two business days of receiving return instructions.

Domestic customers: We will provide a fully insured FedEx shipping label; all shipping costs will be deducted from your refund.

International customers: You must arrange insured return shipping. Returns must be classified as “Return” on Customs declarations. If we incur import taxes due to misclassification, those costs will be deducted from your refund.


Items Not Eligible for Return

Returns declared after five days of receipt.

Items altered per customer request (including ring sizing).

Items with missing or damaged original third-party documentation (e.g., GIA reports).

Payment plan (layaway) purchases—all payments made toward a payment plan are nonrefundable and nontransferable.

Custom items (bespoke pieces)—all payments are nonrefundable and nontransferable.

Multiple returns: If you return more than one item in a 12-month period, a 10% fee will apply to each additional return beyond the first.

Items showing signs of alteration or damage not present at the time of purchase. Rejected returns will be shipped back at the customer’s expense.

Pebble & Polish’s return policies supersede any general return or refund terms that may be presented by third parties (included Shopify, PayPal, Facebook, Instagram, and Etsy). Returns and refunds are strictly governed by the policies outlined above, and no additional return rights apply beyond what is explicitly stated here.

 

CUSTOMER RESPONSIBILITY

Jewelry—especially antique and vintage pieces—is inherently fragile. Customers are responsible for thoroughly inspecting their purchase immediately upon receipt.

If a customer lacks expertise, they should take the item to a local jeweler (preferably one with antique experience) to verify its makeup and condition.

We are not responsible for any issues disclosed after the five-day examination window, including but not limited to: description discrepancies, misidentifications, breaks, defects, or lost stones.

Customers are solely responsible for the ongoing care and maintenance of their jewelry. Pebble & Polish is not responsible for future damages, wear, or deterioration that occurs after the item is received.

A basic cleaning and maintenance guide is available upon request. We strongly encourage customers to establish a relationship with a trusted local jeweler for regular inspections and upkeep.

Customers must retain all original shipping packaging in the event of a potential insurance claim. If the package is received but the contents are missing or damaged, all packaging materials—including all boxes and shipping labels—must be kept for inspection. Failure to retain the packaging may result in the denial of an insurance claim. This requirement does not apply if the package was never received.

 

SHIPPING POLICIES

Shipping Liability

Once a package is marked “Delivered” by the carrier or retrieved from FedEx Hold for Pickup, Pebble & Polish is no longer responsible for loss, theft, or damage.

Any terms regarding shipping responsibility outlined by third parties (including Shopify, PayPal, Facebook, Instagram, and Etsy) do not override Pebble & Polish’s stated policies.

 

Domestic Shipping

Free insured shipping within the continental U.S.

Items ship within two business days after all payments clear.

Packages are fully insured and shipped via FedEx Hold for Pickup

If no staffed FedEx location is available within 30 miles of the customer, we will arrange an alternative shipping method. Special terms and restrictions apply.

Customers must retain all original shipping packaging if an insurance claim is required. Failure to do so may result in the denial of a claim. See ‘Customer Responsibility’ for full details.

 

Failed Package Retrieval

• Customers mustretrieve packages within five days to avoid penalties.

Customers must pay all re-shipment costs if they wish to have the package resent.

If the customer does not request reshipment within 14 days of the package being returned to us, we will issue a refund minus the 20% penalty (minimum $500).

This penalty reflects the significant time, labor, and security risks involved in handling abandoned packages.

Once a package is retrieved from FedEx or marked “Delivered” by the carrier, it becomes the sole responsibility of the customer. Insurance coverage ends at that point.


International Shipping

Contact us with your exact shipping address and item(s) of interest for a shipping quote.

The quoted price includes FedEx International Priority shipping, insurance, and processing fees.

Packages ship directly to the customer’s address, and we request Adult Signature Required where available.

 

Customs, Import Taxes & Failed Deliveries

Customers are solely responsible for researching and paying all local taxes, duties, and tariffs.

If Customs or FedEx requires action (e.g., tax payment, documentation), customers must respond promptly to avoid a failed delivery.

Customers must retain all original shipping packaging if an insurance claim is required. Failure to do so may result in the denial of a claim. See ‘Customer Responsibility’ for full details.

 

Failed International Deliveries & Penalties

If an international package is returned due to customer inaction (e.g., failure to pay import taxes or accept delivery), a 20% penalty (minimum $700) applies.

International shipping failures create additional delays, customs processing, and increased business risks, which is reflected in the higher minimum penalty.

Customers must pay all re-shipment costs if they wish to have the package resent.

If the customer does not request reshipment within 14 days of the package being returned to us, we will issue a refund minus the 20% penalty (minimum $700).

Once a package is marked “Delivered” by the carrier, insurance coverage ends, and the shipment becomes the sole responsibility of the customer.

Pebble & Polish is not responsible for shipping delays beyond our control.

 

HOLDS/RESERVATIONS

We offer 48-hour free holds (except for items posted to our website or Instagram in the last seven days).

Longer holds require a 20% nonrefundable deposit, which initiates a payment plan.

We do not delay shipping for more than two business days. Do not purchase an item unless you are available to retrieve it.

 

PAYMENT PLANS (LAYAWAY)

Available for items over $1,000—please contact us to arrange.

Plans are typically structured over five monthly payments. Extended plans may be available for an additional cost. 

All payments are nonrefundable and nontransferable.

Late fees apply, and failure to complete payments may result in forfeiture.

Full Payment Plan Terms & Conditions will be provided upon initiation. Sample terms are available upon request.

 

ALTERATIONS, SIZINGS & REPAIRS

Items altered, sized, or repaired per customer request are not eligible for return.

Sizing renders an item nonreturnable. If uncertain, purchase the item as-is, confirm you love it, then size it locally. We offer a discount code in lieu of free sizing.

If free sizing is included in a listing, we cover standard adjustments within one size. Complex and/or more drastic sizings may incur extra fees.

Sizing is performed according to our own mandrel (typically within 1/4 step). However, sizing is not an exact process, and there may be slight variations.

Due to differences in equipment and measuring techniques, we cannot guarantee that the final size will match the customer’s mandrel exactly, but we make every effort to ensure it aligns with our own measurements.

We prioritize aesthetic matching over material matching—for example, if antique 18K gold does not color-match well, we may use 14K gold instead.

Pebble & Polish is not responsible for aesthetic or structural changes resulting from alterations.

 

ITEM APPEARANCE, CONDITION, AND DISCLOSURES

We carefully inspect every item for integrity and provideaccurate, color-balanced photos. However, we cannot guarantee exact color reproduction on a customer’smonitor or viewing device, as displays vary. Additionally, jewelry mayappear different depending on lighting and surroundings—please contact us for additional photos or videos if needed.


AGE, AUTHENTICITY, AND MODIFICATIONS

We cannot guarantee the exact age or originality of any piece, nor do we claim that our items are 100% "original." Most antique jewelry has undergone modifications or restorations over time, including but not limited to:

Prong and bezel replacements, new shanks, engraving restoration, replacement stones, previous sizings, enamel restoration, and surface treatments.

Gemstones may have undergone recutting, refaceting, or repolishing as part of their historical journey.

We view our pieces as organic works of history—evolving over time through wear, repair, and craftsmanship. If you have specific concerns about modifications or restorations, please contact us before purchasing, and we will provide as much information as possible.


MATERIALS, GEMSTONE GRADING & WEIGHT ESTIMATION

Metal identification: When possible, we identify metal type and purity based on existing stamps. If no stamp is present, we use the scratch/acid test method to approximate metal content. However, testing is not always possible, and in such cases, we rely on best judgment based on context and experience.

Carat weight & grading: Carat weights and grades for mounted stones without third-party documentation are estimated as mounting permits.

Gemstone grading: Gemstones without third-party reports are graded by an in-house GIA GD using industry standards.

Colored gemstones (non-diamonds): We attempt to identifysynthetic and laboratory-grown colored stones, butwe may not always be able to do so with certainty. The exact origin, chemical makeup, and treatment status of colored stonescannot be guaranteed without third-party laboratory examination.

Gemstone treatments: Many gemstones, both antique and modern, have undergone treatments to enhance their appearance, and these treatments are not always detectable without advanced testing.

 

STAMPS, HALLMARKS & BRAND MARKINGS

Stamp & hallmark identification: We do our best to identify and interpret hallmarks and stamps, including those fromforeign countries. However, due to variations inmarking systems, worn or partial stamps, and changing standards over time,we do not guarantee the accuracy of our readings or interpretations.

Authenticity disclaimer: The presence of a stamp, hallmark, or brand marking does not guarantee authenticity. For example, an item may bear a Tiffany & Co. stamp, but we cannot independently verify that it was produced by Tiffany & Co. unless accompanied by supporting documentation.

Legitimacy of metal stamps: While we use stamps as a reference for metal type and purity, wedo not guarantee that a stamped marking is legitimate or that it has been independently tested by a third party.


PAYMENT SECURITY & PROCESSING TIME

Because jewelry is particularly susceptible to theft, we have security measures in place to protect both our business and our customers. To prevent fraudulent purchases and ensure payment security, transactions may take a few business days to clear.

If payment processing takes more than two business days due to our security measures, we will provide afree shipping upgrade to compensate for the delay.

 

INTELLECTUAL PROPERTY

We retain the right to reproduce, publish, and distribute images and descriptions of all items we offer, including those that have been sold. Usage may include, but is not limited to, social media posts, ad campaigns, website content, and communications.

We also retain the right to physically reproduce an item, including creating anexact copy or an interpretation of the original design.

While we did not design these original antique pieces, their age and rarity make them one-of-a-kind works. As therightful owner of each physical item, we prohibit the unauthorized reproduction of our pieces for personal or commercial use.

We also own the original photography of these pieces. Any attempt to duplicate our antique designs would require the use of our images, which are copyrighted and may not be used without our written permission.

Items purchased from Pebble & Polish may not be reproduced, replicated, or used as the basis for new pieces (for personal use or resale) without our written permission.

All Pebble & Polish original and custom designs remain the sole intellectual property of Pebble & Polish, and we reserve the right to reproduce and offer them for sale.

Unauthorized use of our images, descriptions, or designs—whether antique or original—may result in legal action. This includes but is not limited to:

Reproducing, modifying, or distributing our images without permission.

Copying or replicating our antique or original designs for personal use or resale.

Pebble & Polish actively enforces its intellectual property rights. Unauthorized use of our images, descriptions, or designs may result in legal action, including cease-and-desist notices, DMCA takedown requests, and pursuit of damages.

Pebble & Polish retains full ownership of all images, descriptions, and content displayed on this site. The presence of our images or content on third-party platforms (including Shopify, Facebook, Instagram, and Etsy) does not grant those platforms, or any users of those platforms, the right to reproduce, modify, or distribute our content without written permission.

 

GENERAL TERMS

Policies, prices, and penalties are subject to change.

New York state & local taxes apply to purchases shipped within NY.

We reserve the right to cancel anytransaction before item delivery.

When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address.
When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.
Email marketing (if applicable): With your permission, we may send you emails about our store, new products and other updates.

How do you get my consent?

SECTION 4 - SHOPIFY

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.
Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.

Payment:
If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.
All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.
PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

_shopify_visit, no data held, Persistent for 30 minutes from the last visit, Used by our website provider’s internal stats tracker to record the number of visits
_shopify_uniq, no data held, expires midnight (relative to the visitor) of the next day, Counts the number of visits to a store by a single customer.
cart, unique token, persistent for 2 weeks, Stores information about the contents of your cart.
_secure_session_id, unique token, sessional
storefront_digest, unique token, indefinite If the shop has a password, this is used to determine if the current visitor has access.
